So then how to do I apply for my wife's Tier 1 dependant visa? As she is currently on Student Visa. Hi thanks for the suggestion. I have already e-mailed them, but am still awaiting a reply. While that is more or less clear to me, that I will have to return to my home country for EC, what I cannot understand is that in Tier 1 (unlike HSMP) they directly stamp visa on your passport rather than providing a letter, so in my case what can I expect?WoodieG wrote:Neither of you can switch, you'll both have to leave the UK and get Entry Clearance.

Dependants may not switch into any points-based system tier in their own right. If your dependants later want to be in the United Kingdom under the points-based system in their own right, they will have to leave the United Kingdom and apply for entry clearance.
Knowing HO, I guess this covers all "dependent" visa categories and not just Tier 1 dependents. My suggestion would still be that you write to HO directly and get a clear response from them.

To apply for Tier 1 from your home country.
The most important question is still - Can I and my wife apply for Tier 1, irrespective of whether I have to return for EC to my home country. If I qualify will they grant me a Tier 1 visa and my wife a dependant visa?
Your partner can apply for Tier 1 scheme from within UK (if she is on a student visa and fulfills the necessary criteria). Once she gets the Tier 1 visa, you can then apply for Tier 1 dependent visa from your home country.
On the other hand and most likely, you cannot apply for Tier 1 visa from within UK. You will have to apply from your home country. This done, your wife can then apply for Tier 1 dependent visa, but again from your home country.
But if I am applying for Tier 1 visa, can I not put in my wife as my dependant on this visa?
As above, based on the limited information available on BIA website, you might not be allowed to apply for Tier 1 from within UK. As for your wife, she cannot switch to dependent visa (within any category) from within UK.
