Promotion to different SOC code with ILR due in December

Post by AY10 » Fri Aug 24, 2018 12:02 pm

Good Afternoon,

I am due for ILR in mid December. My company has decided to promote me to senior management last week with around 20% salary increase.

This promotion will be pending FCA approval/authorization which in most likelihood will take another 10-12 weeks to materialize i.e around early to mid November.

Correct me if I am wrong - my current company does not need to conduct RMLT to sponsor me to a different SOC code right?

Secondly can I apply for my ILR under existing Tier 2 visa without applying for a new visa under new SOC code?
I want to avoid going though another visa process less than 4-5 weeks before I am due for ILR in order to save time and money.

Any help would be greatly appreciated.
Thanks
AY

A new RLMT must be carried out if you are promoted to a different SOC code. Once the RLMT is completed, your sponsor will issue a new COS and you will make a new application.

No, if your job has changed to a different SOC code, you will need to make a new application.
I want to avoid going though another visa process less than 4-5 weeks before I am due for ILR in order to save time and money.

I will advise that you delay the promotion until your ILR is done, otherwise you need to make a new application. Your sponsor also need to report the promotion using the SMS, or they could be penalised

Any help would be greatly appreciated.
Thanks

Questions around ILR application

Post by AY10 » Tue Dec 11, 2018 7:26 pm

Good Evening,

I was granted Tier 2 leave to remain on 16 Jan 2014 and hence I am eligible to apply for ILR on and from 20 Dec 2018. I have a few questions regarding this application and it would be very helpful if other members can give their opinion/advice on the below:-

1) Letter from employer- I was on Tier 4 visa before switching to Tier 2 and had started working with my sponsor around 16/12/2013 after which they applied for my Tier 2 visa which was subsequently granted on 16Jan14. Now on the letter which my employer would be issuing me to confirm salary, leave record etc - what should they mention as my employment start date? Should it be 16Dec2013 or 16Jan2014?

2) Refusal of Tier 2 extension:- In Dec2016 - I applied for Tier 2 extension under the same employer which was refused by UKVI due to a clerical error in which my salary was incorrectly mentioned in the COS. The Tier 2 extension was granted on reapplication which was made within 14days of previous refusal.
How should I phrase this in the ILR application and would it have any effect on the outcome?

3) Tourist Visa to France was refused:- In Feb2013, when I was on Tier 4 visa in UK - my application for tourist visa to France was refused due to inadequate maintenance funds. The visa was subsequently granted by French Embassy on reapplication after 2 months and since then I have successfully been granted for schengen visa 2-3 times for further travels.
Again, how should I phrase this in the ILR application and would it have any effect on the outcome?

In the opinion of the esteemed members of this forum - does the above issues warrant me to go through a solicitor or I should be okay to apply on my own?

Thanks
AY
