Subject access information

Post by eliasuk4u » Tue Apr 29, 2008 11:51 pm

I applied for subject access information from Home office under Data protection act (section7) few weeks ago with £10 cheque. I know HO got 40 days to reply but its been few weeks now and the cheque has not been gone through. Wondering whats happening? Any comments on this?

It takes around a month for requests to be processed

The HO sometimes take payment nearer to the 40 days.

Does subject access request has any implication if someone applies for it before applying for ILR?

Depends what type of ILR you are going for. 10 year legal long residency claims seem to have a trend of SAR before application.

There are a few SAR requests from the 14 year illegal applicants once the application is submitted. I believe they are trying to see if there is anything "on" them that will point to a refusal.

If everyting is legal and in order it will have zero impact.

Applied SAR file on 14th April but no reply yet. Not even acknowledgement letter. £10 cheque not gone through as well. Does it take this long?

There has been an up surge of SAR requests recently, do not expect to receive your requests within the 40 days. I know what the law states but forget it.

If you get it back in less than 60 days you will be doing well, less than 90 days would be a more reasonable expectation.
