Hi ..my friend married to a British got her ILR n is due for british citizenship in January 2009 ..recently her mother expired n after her mother's death her husband n her inlaws have been harrassing n physically abusing her as she didnt get a share in her mum's property..i want to ask if she seeks divorce from her husband would it affect her right to british citicenship? ..she has no one in India now.

plz help ;it would be greatly appreciated

A divorce would have no affect on her right to stay in the UK, as she already has ILR. However if she divorces before she applies for naturalisation, she would have to complete five years' residency in the UK, instead of three (as the three year residency is only for people married to British citizens at the time of application). The qualifying residency period is the only thing that would change for her.

As for her husband and in-laws....she should contact the police immediately if she is having serious problems with them. If it is physical abuse, she really should seek legal advice and/or move to a women's shelter asap.
