Can Tier1 dpndt work when the main applicant is not in UK

Dear All,

My situation is:

I am on Work permit and got HSMP approval letter.
I will apply for FLR this month. If I get my Tier1
i need to resign from my company and go back to Home country.

My ques is:

Can my spouse (depandant) work here meanwhile.
I will be coming back in 2 weeks time.

Could anyone please answer..

I tried to search the same, could not find anything.

If you get the Tier 1 visa and your spouse switches to Tier 1 dependent visa before you leave, there is no problem with your spouse staying back in UK and continue working while you are outside UK for any reason.

Why do you want to go back to your home country? Cant you switch within UK? Please correct me if I am wrong but being on WP aren't you eligible to switch to Tier 1/HSMP while in UK only.

I am switching to Tier1. But my company will not allow me to resign from here. The day I resign (I have one month notice period)they will call me back.
I have to go,, is there any other way

Hi.

There is no problem at all,

When you apply for Tier1 then make sure you send your dependant application together with passport (this will also save you some money) ..
Once you receive your passports then everything will be easy.
