am i overstayer?? help on FLR(IED)!!!

am i overstayer?? help on FLR(IED)!!!

I'm a WP holder. Visa valid till 2011..
Came UK FEB 2007 for A company, and worked there till NOV 2007..
Later had another offer and moved to the B company.

When i was working for A company i gave them a month notice before resigning... ie., gave my resignation by OCT last week and resigned NOV Last week.
Meanwhile B company has processed my WP application.. their first application made was rejected because their pay scale didnot match the industry standards. later, they also appealed aganist the decision.. at that time, i was out of my prev A company.

The reason to rejection was a matter of few thousands of pounds that of the industry standards.. After having a discussion with the B company they were willing to apply again with of new pay scale. But, till that time the appeal was on process..

Once we decided to go with new application.. the B company made that application even before the appeal decision came..

Later a month, the second application was approved by Feb 2008 and started working.. but, i was jobless from DEC 07 to FEB 08...
though my application was with home office those period., am i overstayed??

i am applying my FLR this month.. will i have a problem??

To answer your question, we would need to know if your application for FLR(IED) was submitted to the home office before 28 days after you stopped working.

no,i havnt applied yet..
I guess i can go for FLR only after my employer gets the workpermit application granted.
i'm applying flr this month..[/quote]

Only an application for FLR can extend your legal stay, through Section 3C of the Immigration act. So technically, you have been an overstayer. However, these overstays have sometimes been overlooked when applying for further Work Permits and FLR. It might become a problem when applying for ILR in the future.
