eea-fam visa after divorce

eea-fam visa after divorce

i am on eea-family visa, we originally came from germany, we stayed 8 months there, we are now 2 months here in the UK..
our marriage is irretrievably broken down and i want to file a divorce here in northern ireland, we are married 4 years now..what will happen to my eea-fam visa after divorce? we have one child aged 2 with Dutch passport..can i stay with her if the father leaves us here?

It is going to be a bit difficult. You have the right to stay if your marriage lasted 3 years (ok), one of which in the UK (and that is the problem). So if you get the divorce before completing this year, or if your husband moves to Holland (?), you may not get the right of residence under European law. See the Directive 2004/38 for the details, it is quite readable.

You may also get the right of residence based on your child, but that is a difficult case. The Home Office is very much opposed to using children as an argument in immigration matters (for good reason), but the European human rights laws are more positive. Of course this also depends on the father, maybe he wants to raise the child in Holland? There is no point in fighting on two fronts, so you would need his support.

i have been mistreated by his abusive character, just recently he was arrested by the police on strangling me...
so we just talked after he was released from temporary imprisonment that we will file a divorce as undefended divorce which i agreed bec. i dont like to stay with him anymore..

In that case you should be able to retain the right of residence. Since you are no longer a dependent, you will have to prove sufficient means. Did you already apply for a Residence Card? If not, you probably should do that as soon as possible, since the processing will certainly take quite a while.

You should also make sure that you get custody of the child, but I guess that is part of the divorce process.

i haven't applied for the residence permit as i need my husbands passport to apply for it, if i ask him to forward his passport together with the application forms, he might take it against me that i am after the residency here..although he said he will support with that thing but i am still giving a doubt abt that...someone told me that i will write the IND about our case..is it right?

A notarised copy of the passport should also be sufficient. And you will need proof that either he or your are working. This usually means three payslips, although technically one is sufficient.
