Visitor Visa To HSMP transition - Urgent PLZ PLZ Reply

Hi Guys
My wife has applied for HSMP last month, considering the HSMP processing times and insuffeicient funds, we are planning to apply for her HSMP visa only after 4 months.
Meanwhile I want her to join me in UK on visitor visa for next 4 months. Then she will go back to India to apply for HSMP visa.

I want to confirm on Forum that even if she hold visitor visa - she should be able to apply for HSMP visa (as long as she fulfills the HSMP criteria)?

I am not ware of any such restrictions if anybody know any such cases please share with me.

Applying for HSMP from India even when holding a valid visitors visa should not be a problem.
Although if I'm not wrong, your wife would now need to apply under the new PBS Tier1 category instead of HSMP when applying from India.[/quote]

Yes, she needs to apply for visa as per the Transitional tier-1 arrangements as she has applied for HSMP letter just before April.

I'm not sure why she had applied for separate HSMP , when she can enjoy same employment rights as yours.

do you know if you will get 3 months visa or more?
because you are planning it for 4 months you have to consider that.

Your spouse can apply for a visit visa as there is no such restriction that prevents her from doing so. An HSMP application doesn't stop her from visiting UK for any reason - be it family visit, business / work, or tourism.

Even when she has the HSMP approval in hand, nothing stops her from applying for EC as a visitor until such time that she applies for EC based on her HSMP approval.

As usual, you /your spouse will need to provide documentary evidence in support of the visitor visa application, that's it. Check the VFS site.

BTW, visitor visa is currently issued for 6 months (unless a long-term is requested).
