Comprehensive health insurance (home student)

Post by romeol » Mon Nov 12, 2018 10:51 pm

Hi guys, I have been slightly confused over my situation so wanted to check with you, perhaps someone has been in a similar situation.

I have been in the UK since 2007, moved here with my parents from Lithuania (dad has been here since 2004, mum arrived at the same time as me). I was 13 at the time, did 5 years of school completing my GCSEs and A-levels in 2012 (when I turned 18). These 5 years would qualify me for PR.

I then went onto to study at University in 2012, my BA was 4 years, and my MA was another year, which I completed in Septemeber 2017. Since graduating I have been working full-time (14 months now).

The problem which I encountered is the Comprehensive Health Insurance section.

I applied to university as a home student, received student finance etc. I was not aware that I needed health insurance like a foreign student would because I applied to university as a home student. (also this was never ever mentioned to me by either the university or student finance England, UCAS etc.)

I have now been in the country for 12 years, 10 years as a student, and since graduating I have been working full-time, meaning that the if this rule is applied, my 5 years as a university student would not qualify.

Ultimately I have 5 years of study at school (which I guess CHI does not apply to as I was under 18 and relying on my parents)
5 years at university (as a home student, but without CHI)
and now 14 months as a full-time employee (CHI not required as I am self-sufficient?)

What are the chances of my application being accepted without the supporting documentation for CHI if I simply stated my case in detail with proof of school/university attendance and the most recent work documents.

Also

Would another option be to apply as a family member of my mum or dad who have been in full-time employment for 10 + years.

If someone has any info on this it would be highly appreciated.

Apply as dependant of one of your parents for the five qualifying years you were in secondary school - provided they were exercising treaty rights during those five years.
If you didn't have CSI or an EHIC card from your country of origin, the university years don't count as the qualifying years for PR.

And to qualify for naturalisation, if the immediate 5 years post school I was technically not exercising my rights , does this gap matter ? Or could I use the year of full time employment since graduating from uni to make up the 6 years required for naturalisation.

No, no need to exercise treaty rights after PR and for naturalisation - just need PR + 1 further year.
So, you will be able to apply immediately after PR, provided 6 years have passed in total.
