FLM(M) form Section 5 - Q5.9 & 5.10

Post by Hhwan » Sun Nov 25, 2018 6:28 pm

Good evening,

My husband is applying for an extension for his spouse visa and preciously did overstay (more than7years) but thankfully was successful with his first application.

Now filling the form for section 5 question 5.9 asks
"Have you ever been deported, removed or otherwise required to leave any country including the UK in the past 10 years?" I would think yes as he did overstay and left the country to properly apply for a spouse visa. Give details of dates he entered and left/ hubby was very wrong to overstay and would otherwise required to leave the country.

The next question 5.10 askes
"Have you ever remained in the UK beyond the validity of your visa?"
I again would think yes and only give the dates he entered and left the UK only.

I feel like question 5.9 is aimed for applicants that have been caught by immigration and you would have been either deported , removed or voluntarily left the country.

And question 5.10 is aimed at applicants that where not caught by left the country on their own.

Am I over thinking this?

Thank you for you time and help
Helen
