Hello

I moved to this country in Dec 2013 on Tier 1 dependent visa. My husband had a solicitor working on his behalf for all his successful visa applications(of his and his cousins) before our marriage. We trusted her blindly with our ILR application in 2016 June. My husband got his ILR fine but she has applied FLR(M) for me.

We were hoping to apply for my ILR this dec, since it's going be 5 years now for me in this country. In this process, yesterday, we found out that my clock has been reset in 2016 due to change in Category. I have been told that I don't have any other option other than applying for FLR(M) extension again and wait for next 2.5 to get qualified for SET(M) ILR.

Has anyone been in a similar situation? Is there any other option to switch back to PBS dependent and be eligible for ILR?

Any help is much appreciated.

No. Switching to a PBS Dependent visa would re-set your immigration clock to zero once again.
Also if your husband has ILR you can no longer apply as a PBS Dependent. You have no choice other than wait out your 5 year qualification period under FLR(M).

Unfortunately, you will also have to pay the NHS surcharge which is expected to increase to £1,000 for the 2.5 year visa later this month. This is in addition to the visa fee.
