Tier 2 General (Employer Sponsored) - Dependant

Post by sur137 » Tue Dec 04, 2018 1:58 pm

Hello,

My Teir 2 General visa's validity is getting up by 14th Feb 2019. My company is in the process of submitting extension application. They are not going to add dependant info in my application, they said we need to do that on our own. They are applying for extension using standard route. These are company policies so I have to follow this process.

Question: As standard route takes 8 weeks, after the application is submitted, I was wondering if my husband can apply for extending his visa right after my application is submitted. Or does he have to wait for me to get my BRP? When can he actually apply?

Thanks in advance for your help.

Regards,
SP

Generally your company would issue COS to you and you apply for visa extension. In that application you can include your dependents as well for their visa extension.

If your company is going to apply and pay visa and IHS fee then you can submit your dependent application at a later date using the COS details or as soon as you get your BRP but before their visa expires.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Yes my company is handling the entire visa extension process for me. They don't deviate from the process they have internally set out. So my dependant has to apply on their own later.

Now on UKVI website I read the following:

"Apply to extend or switch your visa or leave to remain as the spouse, civil partner, unmarried partner or same-sex partner of a Tier 1, 2 or 5 worker or Tier 4 student.
You should use this service if you are applying after the main applicant has already submitted their application or been granted leave in one of these categories."

Would this not mean, that they can apply as soon as I have applied? Waiting for BRP will take a long time. As after the approval, it takes another 10 days I think for the BRP.

Yes, that's what I have mentioned as well...
