I recently got my teir 1 enterpreneur visa granted in DEC18.I dropped for extension in May17( where it took 17 months )
My question is by May19, it will be on this teir for 5 years.
I would like to go for ILR.
I have a 2 Situations here
1. I need to show 2 full time employees for 12 months, i have 1 full time employee and 2 partime employees, that full time employee left the job in june18 now i have only 2 partime employees till today any i don’t have any other employees. Can i claim the first employee hrs from may17 to may18 as 1 and the two partimers as one employee
2. My visa was granted till 2020 . Once if i applied for this ILR is there any chance that i can travel other countries before my application is approved.
Please Help me on this ....
Thank you.
The new rule ?tier11417 wrote: ↑Sun Dec 09, 2018 10:39 pmYou could have benefited with the new rule where you could claim 12 months immediately before the date of ILR IF you had 2 FT “jobs”employment during May 2018 - May 2019 but since you need full 12 full months for your “Job 2” earliest you would be applying is Dec 2019 so this rule will not benefit your case.
The rule is you have to claim for job creation AFTER extension for ILR.var1987 wrote: ↑Tue Dec 11, 2018 11:39 amThe new rule ?tier11417 wrote: ↑Sun Dec 09, 2018 10:39 pmYou could have benefited with the new rule where you could claim 12 months immediately before the date of ILR IF you had 2 FT “jobs”employment during May 2018 - May 2019 but since you need full 12 full months for your “Job 2” earliest you would be applying is Dec 2019 so this rule will not benefit your case.
Which means i can go for ILR in May19tier11417 wrote: ↑Tue Dec 11, 2018 12:22 pmThe rule is you have to claim for job creation AFTER extension for ILR.var1987 wrote: ↑Tue Dec 11, 2018 11:39 amThe new rule ?tier11417 wrote: ↑Sun Dec 09, 2018 10:39 pmYou could have benefited with the new rule where you could claim 12 months immediately before the date of ILR IF you had 2 FT “jobs”employment during May 2018 - May 2019 but since you need full 12 full months for your “Job 2” earliest you would be applying is Dec 2019 so this rule will not benefit your case.
but the exception is: if your most recent leave to remain was granted less than 12 months ago (which is true in your case) you can claim for all the job creation in the last 12 months immediately from the date of ILR application.
For example someone who got extension in Dec 2018 but is eligible to apply for ILR in May 2019. He can claim for all job creation from May 2018 - May 2019 (given he meets the job creation requirements POST transitional but you dont meet those)
When i spoke to my Laywer today he says we can go fo the ILR this May19 i am in confusion now who should i believetier11417 wrote: ↑Tue Dec 11, 2018 12:29 pmNO. Please read my post carefully. As you are post transitional you need 2 full time “JOBS” for 12 months. You do not qualify for that as you did not have any job 2 in that period. You have to creat a new “job” for 12 months from now and can only apply once you fulfill that requirement.
Okay how do you think you will qualify for 2 FT “jobs” from May 18 - May 19 that existed 12 months each?var1987 wrote: ↑Tue Dec 11, 2018 12:33 pmWhen i spoke to my Laywer today he says we can go fo the ILR this May19 i am in confusion now who should i believetier11417 wrote: ↑Tue Dec 11, 2018 12:29 pmNO. according to Job creations we can show employee in the first 12 months or 2nd 12 months right.
