Deportation

Post by Barb » Wed Dec 12, 2018 11:29 am

My husband was sentenced on the 28th of Nov 2018 to 12 weeks in prison for assault. He got British citizenship on May 2018. He has also Italian passport. Could he be deported? The police officer that took care if his case said he will be deported after prison, he will inform Home Office.

I don't think a police officer can make this statement in law. Did he know about the dual nationality? Did the court mention this in their ruling?
I am not an expert but as assume that a British citizen will be treated as such under British law. There have been well-reported cases where dual nationals have been stripped of their British citizenship, but they were very serious cases. Not a law expert, so can't give any definite answer.

Thank you for your reply. The police officer knew about the dual nationality. The court didn't mention anything.

Has there been any feedback from the Home Office?
