ILR Application for children

Post by prash88 » Fri Dec 14, 2018 12:32 pm

I moved to UK from India with my wife and son in Oct -2014. I am on Tier2-General visa. My wife and son do have Tier2-Dependant Visa. We have 5 year valid Visas which will expire in 2019 Oct. My daughter was born in Nov 2015 and also has Tier2-Dependant Visa which also expires in 2019 Oct. We are due for our ILR application in Sep 2019. Recently there has been a change in circumstance and my wife has received an offer to work as ‘doctor in training’. This requires her to obtain a new Tier2-General visa in Feb 2019 as she cannot work as doctor in training on a Tier2-Dependant visa. Since she is moving from being a Tier2-Dependant to Tier2-General visa holder, I was made aware that she would no longer be eligible to apply for ILR in Sep 2019 and she would have to wait until Feb 2024. I wanted to find out if my kids would still be eligible for an ILR application (along with my application) in Sep 2019.

Any help/guidance would be very useful.

Yes they would as you kids can remain as your dependants. You wife will have to apply for a new visa herself and follow her own PBS path
