HSMP Rejected - Need Help

HSMP Rejected - Need Help

I had applied for HSMP under the old point system. I got a letter from home office saying its been refused. I am currently in UK under work permit (for the past 1 1/2 years). I am getting indian salary and UK living allowances. I had claimed for 35 points under salary and had submitted my indian salary slips. The home office has rejected these saying as I am working and satying in UK my salary will be checked against band A for UK. This band is too high and I cant show it as am not getting salary in UK. I am planning to apply for review. Please help

If that's the rule, there's nothing you can do about it. It simply means that you do not qualify for HSMP and you should have known this before applying.

Para 43 in Annexure C of the HSMP Guide states "If you are living and working in a country but having your income paid into a bank account in another country your income will be considered against the country code where you are living and working". The key factor here being the country where you live and work (UK) and not the country where you get paid (India).

What will be your basis of requesting a review ... if I may ask?

It seems you didn't understand the HSMP guidelines correctly. You will be assessed against the band of coutry where you worked and lived, in this case UK.

No need to apply for review. You need to include UK allowances as well in your total earnings, provided they are declared in your payslip (otherwise take a letter from employer about allowances paid). And payslip should supported by Bank statment.

Agree with others. This is unfortunate, but a review would be waste of time.
