Hello Friends,
I came to the UK in 2011 on a visitors visa but overstayed until now. I met my partner in 2015, who then had a daughter from her previous partner. By virtue of her ex-partner having indefinite leave to remain her daughter was issued a British passport. I moved in to stay with her in the same address with her British daughter since March 2015.
On June 2016, my partner had another baby with me whiles we live with her British daughter in the same address. My partner then applied for FLR FP on the basis of her British daughter and added my own biological son to the application excluding myself. They were both issued BRP on the basis of their relationship with the British Child. In her application including my son, she reiterated to the Home office, She doesn't have any contact with her EX-partner. But still, the application was successful. We have gone ahead to have another son, making us a family of five.
Now. I want to submit an application on the basis of family life and my relationship with the British child who is not my own biological child, my partner who holds a leave to remain and my elderly son who also holds a leave to remain.
I have letters from the children health visitor who stated in the letter that she's aware I have parental responsibility for all the three children and has met me several times in the address, the GP that I bring all the three kids including the British child to the GP and they live with me,my British daughter's school(not my biological ) that I bring her to school and they know I live with her including email correspondence between myself and them,also thinking of adding family pictures to the documents
Also, I have documents from the council that suggests we have lived in the same address since 2015, joint bills from Anglian water, joint bills of tv licenses, joint bills of EDf and other relevant bills which cut across for over three years.
Please what are my chances if I make an application on the FLR/FP (parent or partner) or if they decide to make a decision outside the rules, what are my chances. Thank you

I will first question whether you have parental responsibility for the British Child. It is not automatic, the other partner will need to give you authority to have parental responsibility or an application will need to be made to the family court.

I do not believe you qualify under the rules at all, probably they may consider your case outside the rules, but within the rules, you are not a parent, as there is no proof that the child's father is dead.

May need a bit of fight as it is not a straightforward case.

I have the conviction that it will be decided outside the rules, can you please explain what you mean by there's going to be a bit of fight.

Hi. Bit of fight mean your case is complex and you may have to fight in court.
