Hi,
I am a Bulgarian national completing the form for Permanent residency. I have been working in the UK since 2010 but I have just found out that prior to 2014 I should have applied for a WRS but did not as i did not know. I have always worked and never claimed anything. I have the following questions and would appreciate any help or advise
1 - Is this going to affect my application? ie.e will it get rejected
2 - I am thinking that I should wait until after 01/01/2019 to apply as that would mean that I would have worked in the UK for 5 years without the need for WRS. If I wait until then I am not sure how I should answer these questions as these years will not count as part of 5 years continuous work.
Did you work for an employer in the UK during the relevant accession period?
Did you work during the accession period without holding one of the documents listed earlier?

Romanian & Bulgarian restrictions were lifted 1 Jan 2014. Anything before that were required to apply for Work permit/work registration certificate and within working 1 year for the same employer then apply for WRC which allows you to work with any employer. If came under Agriculture scheme then needed to apply as well so as students. As you have stated that didn’t apply any of the above. Your qualifying period starts when restrictions were lifted 1/1/2014 hence you need to apply in 1/1/2019 which is 2 sleeps/days away. As we are hitting nearly March 2019 had wait to apply for document certifying PR of which will be eligible too.

That is a tricky one - as HO wants you declare whether you did work without authorisation from them. However a good thing is if you have work with accession card will also count toward your 5 years qualifying period. From your thread seams like you didn’t apply accession card but a good thing is you only need to state which qualifying period applying for. For you would be 1/1/2014 to 1/1/2019. So anything before that is irrelevant to HO. If you have P60s & Payslips for the qualifying period have advised you should be worried. But the HMRevenue history of employment will definitely show you did work the year ending April2013/ April 2014. However won’t affect document certifying PR application neither settled status in future. It is not criminal offence. Hence would honest about it and say no you didn’t apply for accession card but worked as this is not citizenship application don’t think will affect it. Note that HO looking for qualifying period only.
