Hi amirhazz,

From the e.mail text wording it looks like you have been granted LTR now on 10 years or 120 months route ....But also your FIRST post also suggest that you were originally granted LTR on 10 years route ... have you checked your first spouse visa ENTRY clearance was on 5 years or 10 years route ?

Did you meet all immigration requirements including income £18600 p.a? Very confusing your posts are ?

Their email is absurd. Calling her a parent under E-ILRP.1.3. was a simple mistake. They apparently made far bigger errors. Their email appears to be uncertain as to whether she is on the 5-year or 10-year route. This refusal hasn't curtailed her leave nor changed her route.

They also failed to consider that her leave is valid until 29 March 2019. Moreover, if she entered the UK on 21 September 2013, and she had already completed 5 years and all the 5-year requirements under E-ILRP.1.3.(1)(a) on the date of the decision, then they should have granted her ILR.

If she satisfies the requirements for ILR, then there is no requirement for her to make an unnecessary FLR(M) application. See also similar case.

If I were you, then I would also ask your MP to contact the reasonable Home Secretary for help.

Thanks, vinny,

They communicate very bad English, we paid almost £5000 and waited 4 months to get these errors? I don't get it.

And yes she satisfies all the requirements and if that wasn't the case, they would've written in the refusal letter.

I already paid for NHS and good suggestion: i will also email MP about this.

Paying the Immigration Health Surcharge is also unnecessary, if she is applying for ILR. Be careful that they further compound their errors by putting her on the ten year path!
