Tier 1 visa refused after 22 months

Happy New Year to everyone

I have few question regarding Tier 1 (Ext) 50K pending application.
I applied Tier 1(Ext) on 19 May 17.
fingerprints after one week.
have an interview march 18
send reminder through MP but same letter as complex issues
1. If they(HO) not reply till April 19 can I vary my application and apply ILR?
2. if yes ; so can I apply 28 days before or I have to wait till my 5 years complete time.
3. I have 3 Employees since 2 years ( 1 full time and 2 part time till now) are they fine to claim?
4. my dependents (wife and 3 children) also pending application with me. so which form I have to
complete (they are in UK from 9 July 16) 2 years and 7 months
5. do I need maintenance statement for dependents?

I will appreciate to all member for your comments and experiences

1. If they(HO) not reply till April 19 can I vary my application and apply ILR? ==> Yes, but I am yet to see a case here that came to that
2. if yes ; so can I apply 28 days before or I have to wait till my 5 years complete time. ==> 28 days before.
3. I have 3 Employees since 2 years ( 1 full time and 2 part time till now) are they fine to claim? ==> Yes, you can use the same employees/evidence that you did for the extension applicaiton
4. my dependents (wife and 3 children) also pending application with me. so which form I have to
complete (they are in UK from 9 July 16) 2 years and 7 months ==> They will still be on PBS dependant, so there is no need to vary their application.
5. do I need maintenance statement for dependents? ==> No, you should not need that as their application is not being changed.

The comments above are my understanding of the immigration rules - I doubt if they have been tested and I suspect you will get a decision before your eligibility also.

Nothing changes with your dependants. They stay on as PBS dependants until they complete their 5 year.

I m silent member on this foram. I have couple of posts before. I have few questions if you share your experiences.
I applied Tier 1 ext 19th Many 17, and have an interview on 22nd March18. and I received Refusal 18th March 19. The refusal bases on genuineness and job creation. HO only gave points Maintenance and English language
rest HO didn't gave any poients bases on Genuineness. And My company also going to lost. I spent almost 60K investment, but now for me very difficult to continue business due to financial circumstances. I have 8 months for my 10 years. can you please advises me if I can get Tier 2 can I met for LR requirements?
or any other options I can reach 10 year.

I will wait for valuables response

What was the basis on which they determined it as non genuine ? Are you in agreement with their decision ? Yes, you can apply for Tier 2 within 14 days of refusal or if you file AR, within 14 days of any potential negative AR decision. Your 10 year stay will not be broken IF that application is successful.

You are potentially eligible for 5 year ILR, but of course that is the same criteria, so that may be tougher.
