Working Holidaymaker Visa Rejected

Post by PharmerDan » Thu Jun 05, 2008 2:17 pm

I have been rejected in the grounds of
9b
(iv) has the means to pay for his return or onward journey
(v) is able and intends to maintain and accomodate himself without recourse to public funds
(vi) is intending to only take employment incidental to a holiday

I believe I can amend (iv) and (v) fairly easily. They have determined that I only had $1300 in my bank, and didn't factor in my offset account for my home loanwhich is attached to my home loan, which has over $30 000. I imagine that a visa application officer is not well versed in the liquidity of funds within a home loan.

Will transferring the funds across into my statement account, printing this off, be sufficient evidence for (iv) and (v) be suitable? I imagined they would have laughed when opening my application. $1300 in the bank? $4000 per month in bank repayments? The man will be broke within half a month!

Now, in regards to point (vi), they believe that I will not be working incidental to a holiday, but rather, need UK earnings to be remitted back to Australia to repay a housing mortgage.

I have stated that I will be repaying this loan via UK earnings, savings, Australian employment leave and parental assistance.

I imagine that they would be more satisfied with giving me the green light if I wasn't dependant on UK earnings at all to repay this loan.

I can source a statement from my property manager regarding my rental income of about $2000AUD.

With parental assistance, do you believe a statutory declaration stating that my parents will be gifting me the sum of $2500 per month (and hence adding up to $4500 - this outweighing the sum of $4000 of repayments) be enough for their eager little hands?

Then I can remove that I will be requiring UK earnings to help pay for the loan.

What do you guys think?

See this:

TS (Working Holidaymaker: no third party support)

from the Asylum and Immigration Tribunal website
We are satisfied that the express terms of paragraph 95(v) require an applicant to demonstrate at the very least the ability to be self sufficient, throughout the duration of the proposed visit. We conclude that an applicant will not make out the necessary requirements if he is constrained through his financial circumstances to rely, either in whole or in part, upon promises of financial support, whether to meet his maintenance, or his accommodation needs, and, whether they be made to him by family, or friends, or whether they be promises of money, or money’s worth. He has to be able to show that he has sufficient from his own resources (including the ability to do a limited amount of work merely incidental to a holiday) to fund the trip.
Even your rental income is not guaranteed. Tenants leave after all.

It does not look that hopeful, maybe others will have better ideas for you.

Regards

Why didn't you send the bank statement for the offset account showing you have $30,000? (Do you mean offset account or redraw facility?)
