Hello

I'd like any in put or advise you could offer.

I am a Canadian married to a Brit on the 2nd half of my Spousal Visa 5 year plan. My spousal visa expires in July 2019 - and then I can apply for ILR.

Here is our conundrum. My husband left his job in September 2018, it was a new job he had been at for 7 months - prior to his joining this company he had been in long term employment with another organisation.

He is currently looking for new employment - and he hopes to find something in the next few months.

During his time at previous job he made over 40,000 gross in 7 months MARCH 2018 TO SEPTEMBER 2018 (he was on 72k annually)
Prior to that his annual salary at his previous job was over 55k
Any new role he takes he will have a salary at the very least of 60k

Now we are clear that we will need to apply under Category B (salaried employment under 6 months)

However when does he have to find employment by for us to qualify?
I know that we must provide 12 months prior to application earnings ... does mean:
a) tax year April 2018 to April 2019
or
b) Literally 12 months prior to July 2019

Any insight you can provide would be grateful.

As an ultimate worst case scenario - and he doesn't have a job, what happens to me? When do I have to leave to go back to Canada? We have a daughter - she is British.

Unless you have substantial savings, your husband needs to be in employment when you submit your ILR application.

If you are unable to meet the minimum income level, you should apply under FLR(FP) Partner route.
(Casa, not CR001)

Do YOU work?? Your income can count towards the £18600 too!
