I would withdraw and apply new. After, chase HO for refund. I would fight for the refund even if I have to take them to small claims court.

Hello again sorry for the inconvenience caused!

I just read this document

On page 8, it says "Where the fee has been paid but the application is invalid, the caseworker must reject the application and process a refund for the application minus £25 per person included in the application form"

On page 5 of the same document it says "An application for leave to remain in the UK is valid when the requirements of paragraph 34 of the Immigration Rules are met"

Now, immigration rule paragraph 34 states that an application is VALID only if it meets paragraph 34 (1) to (9)

Now, 34 (9) states " An applicant must comply with the application process set out on the visa and immigration pages on GOV.UK and in the invitation to enrol biometrics which is provided as part of the application process in relation to –
(a) making an appointment to provide biometrics

And, according to the same rules what is an INVALID application? "where an application for leave to remain does not meet the requirements of paragraph 34, it is invalid and will not be considered"


NOW, to put it in a nutshell what i can understand from all these documents that my application is INVALID as I have not done the biometrics and have not even booked the appointment (Please correct me if I am wrong)!
and if my application in INVALID I can get a refund minus 25£ administration fee!

Yes but with the new system you get around 2 months (i think) to book an appointment for the biometrics. If you dont attend the biometric or book an appointment I think they will send you a reminder in 15 days.
The above looks all true and your in good position with getting a refund but it is a race against time that how long you would have to wait for your application to be considered invalid.

I have not heard anything from them yet. They have sent me a letter stating that if I do not do the biometrics till 7th march 2019, my application will be invalid. I have not done the biometrics yet and still waiting for their response. I will keep you update as soon as i hear anything!

JUst to update on my case!

I got the full refund for the wrong application made earlier, submitted a new application yesterday on super priority basis and got ILR approved yesterday.

My ILR was based upon Tier1 E and Tier 2G.

I am really grateful to all the respected members for their support.
