Home Office asked to make a fresh application as formalities after appeal is allowed

Dear Sirs

I sponsored my Brother-in law to bring him in UK under ADR(Adult Dependent Relative). His application was refused but appeal is allowed by the Upper Tribunal.
Now Home Office is asking to make another fresh application as formalities and ask to submit another bio-metric to allow his appeal. They said(British High Commission New Delhi), they can not process application which cross 120 days.
He also asked to put in new application the reason for visit as work, through he made settlement application and appeal allowed in Human right ground.
I am not sure as to why he needs to make another fresh application as he has already done this and submit bio-metric with original application. They also said he does not need to pay fee as he has already paid.

I would appreciate, if you could kindly let me know what to do in this scenario, should I follow their instruction or write to them.

It's strange that they asked him to make another application. I will like to hear some opinion from experts on this website.

By the way, how long did it take the home office to get back to you after you won the upper tribunal appeal? Can you write your timeline please?

Hi

He made further application according to their instructions and now received leave to enter for 32 months rather than indefinite leave to remain.

Could you please advise what to do as ADR(adult dependent relative) rules specify that the person meet the rules or appeal allowed should be given ILR.

If he satisfied D-ECDR.1.1., then they should have granted an ILE endorsement. Ask for a correction.
