I am married an European national who is living in the UK for around 10 years, he's now a student of the university of Buckingham. I am a non-european national, when I came to the UK I didn't apply for a FAMILY PERMIT in Brazil, as the lawyer said we could get a "family permit" at the airport at the immigration border.
We did it, on the 23rd of Nov 2018 we came from Brazil and the immigration officer stamp on my passport "ADMITTED TO THE UNITED KINGDOM UNDER THE IMMIGRATION (EEA) REGULATIONS 2016.
I recently applied for my Resident Card and unfortunately it's been refused because my spouse was not studying when I applied for it, they said I couldn't prove that he's a qualified person. Well, now he's a student and a qualified person.
On the letter that I received from HO saying that I had a refused application they said: "Direct family members of EEA exercising treaty rights are not required to apply for documentation to confirm their rights to reside in the UK." Then I decided to wait until the settled applications open to apply for my pre-settled status.
Questions:
1. Am I allowed to work? *NOTE: I am already working, just want to confirm if I do have the rights*
2. Am I allowed to stay in the UK? If yes, for how long?
3. Shall I try to apply my resident card again or wait for the settled status begin? *NOTE: residence card will not be valid after 31 December 2020. You and your family can apply to the EU Settlement Scheme to continue living in the UK.
4. If I travel abroad without my husband (EEA NATIONAL) will I have problems to enter again in the UK?
5. Having this stamp on my passport, which queue shall I go at the immigration border?
