EEA Family Permit a few questions

Post by vladimir1990 » Mon Feb 18, 2019 3:15 pm

Hi all.

First I want to thank you all for helping people all around the world with their immigration questions. My wife and I use this forum as a source of information since we started dating.

Just a small summary of my situations before I can ask questions.

I am EEA national (Hungarian passport). I am 28 year old. I am living it UK for 4 years and 10 months now. I am constantly employed since I came here.

My wife is a Serbian national, she is 29 year old she has been living in Serbia since she was born, she has a Serbian passport. A few extra details about her that might be important, she applied for UK visa before she met me for voluntary work and the visa was accepted (she visited UK two separate time, didn't break any laws left on time). She again applied for a visa in 2018 September this time to visit me, the visa was denied.

We got married on 5th of January 2019 after 6 months of relationship. We are currently in a long distance relationship, I have visited her in Serbia 3 times so far. The plan is to move her to live with me in the UK, the first step is acquiring the family permit and later a permanent residence.

I marked the questions from the form with "Q", and our answer is marked with an "A", we want your expertise if those answers are ok, where there is no A we want your advice what should we put there

Question time:

Q:What is the main purpose of your visit to the UK?
A:Joining her husband to live in the UK.

Q:How long do you intend to stay in the UK?
A:She would like to stay in the UK with me for the 6 months duration of EEA family permit and during that period she can apply for residence card while in UK.

Q:On which date do you wish to travel to the UK?
Is it better to put the date 3 months after applying or put a date earlier than 3 months?
Because we would like her to come to the UK as soon as she receives her family permit, and the waiting period for the process is up to 3 months. What should we put here?

Q:On which date will you leave the UK?
What should we put here? She would like to apply for the residence card during her stay with EEA family permit, and she wants to continue living with me.

Q:Have you ever been refused a visa for any country, including the UK?
Yes, Date 13 September 2018, UK, Reason: There is a list of reasons, should we put all of it?

Q:How often do you meet?
A:29.07.2018. (6 days), 24.08.2018. (10 days), 22.12.2018. (23 days)

Q:When did you last see the EEA National?
A:We saw each other on 13 January 2019, we will see each other again when I come to Serbia in March before she apply for the family permit.

Q:Have you met the EEA National?
Yes. In guidance it says to provide documentary evidence to support this, what can be used as evidence? Photographs of us together?

Q:Is the EEA National responsible for anyone’s financial support, including any children listed above?
Is it consider to be financial support if I send 130 pounds every third month to my mothers bank account? Or that I have sent to my wife (then my girlfriend) money occasionally?

Q:Will you or the EEA National receive income from any other sources, including friends or family?
A:EEA Nationals father (name of my father), who lives with him is paying some of the expanses for the flat (around 500 UK Pounds Sterling for food and other supplies for the flat). Additionally he is sending each month around 250 UK Pounds Sterling for bills/utilities (details of these payments are provided in EEA National bank statement).

Q:Do you intend to work in the UK?
A:Yes. When I arrive to London I plan to look for work.

Should we fill in part 5 of the application form?
It says TO BE COMPLETED BY
- extended family members of an EEA national applying on the basis that they are dependent on that EEA national, or
- dependent direct family members (this does not include spouses, civil partners or children under the age of 21)

Here is the link for the form we are populating

A few additional questions we have:

Do we need to buy air tickets for EEA family permit?

In checklist it says we need to provide evidence of how her trip is to be funded, what can be used as evidence for that? I will pay for her flight tickets and I will travel with her as well.

Quotes from the guidelines:
"Evidence of your sponsor’s employment or other economic
activity, e.g. payslips, details of receipt of state benefits, details
of their studies in the UK, student identity card"

"Evidence of your sponsor’s whereabouts, e.g. payslips or
tax documents specifying place of work, mortgage or bank
statements showing their address, rental agreements, council
tax statement, benefit book"

Is my bank statement and payslips enough? I will also put the tenancy agreement as evidence of my whereabouts.

Since my wife is unemployed and lives with her parents, can we send bank statements of her parents for the last 6 months? She also has statement from the National Employment Service that she is currently unemployed, should we send it as well (we will officially translate this from Serbian)? I was sending money to her bank account occasionally for the past 6 months, but on her foreign currency bank account doesn't show the exact source of money. So it doesn't connect my bank account with hers. It says it on my bank statement though.

Do we need to officially translate screenshots of our chat?

We will send screenshots of video call logs as evidence of our communication. But since we talk every day how much of those screenshots is necessary to send?

Thank you, any help is appreciated.

Really great summary of your story Vladimir. Me and my Russian fiance are going through the same process! Any reply to your post would be a great asset for our file as well. Have you found any good information so far? How long does it take for an EEA FP to be released?
