IRL Financial requirements, When to apply confused

Post by Hathai » Tue Feb 12, 2019 5:07 am

Good morning Folks
I am sorry to bother you with this but I couldn't find a definite answer to my question.
I am a Thai national married to a Czech national. I am confused about entry to the UK in the past. We have applied for a 6-month (entry clearance) visa before my arrival in April 2014 ( 6 months also able to be full time employed) We have applied for EEA2 and received a 5-year visa (received AUG 2014)
Now the confusing part is to when am I able to apply for IRL is it the 28 days prior to the one issued in April or do I have to wait until my EEA2 is 28 days due to expire in August?

The last question is my husband is full time employed with a salary £24K but my salary is only £18550 p/a is this going to be enough? does our salary add up or does it have to be each at least £18600? (no kids)
Please don't laugh at our little money as we are both working class people.
Thank you kindly for any answer
Regards
Hathai

First of all, you apply for the Settlement Scheme: https://www.gov.uk/government/collectio ... nformation NOT for ILR.

If:

a) you were already married to your Czech spouse by the time you entered the UK in April 2014, or
b) you were not yet married, but the 6-month entry clearance you describe above is a EEA Family Permit,

then in any of the two cases above the start of your clock is your entry date in the UK in Apri 2014.

In any other case (e.g. you were unmarried when entered the UK and did not have a EEA Family Permit), the start of your clock is the moment you were issued your 5-year EEA residence card, in August 2014.

You can apply anytime for the Settlement Scheme.
If you apply before 5 years have passed since the start of your clock, you will likely be granted Pre-Settled status.
If you apply after the 5 years have passed since the start of your clock, you will likely be granted Settled Status.
The last question is my husband is full time employed with a salary £24K but my salary is only £18550 p/a is this going to be enough? does our salary add up or does it have to be each at least £18600? (no kids)
There is no financial requirement to apply for the Settlement Scheme.
