ILR SET(M) / Passport expiry and visa application date

Hi All

Ill appreciate help, my partner is currently on Spouse/Partner Leave to Remain / 5 year route. First issued 15/04/2014 in UK till 15/10/2016, and second visa issued also in UK on 13/12/16 till 15/06/19.

If I understand correctly the earliest she can apply for ILR (using SET(M) form) is 28 days before the end of the 60 months qualifying period, in this case she can apply earliest on 18/03/2019?

Also, her passport expires on 04/11/2019, if she has to apply 28 days before the end of the expiry of her current visa 15/06/19, I’m not sure how this will influence the application, considering the passport will be valid for another 5 months only.

The passport only has to be valid at the date of application. There is no rule that passport should be valid till a decicion is made.

Also, the 5 year qualifying period starts from the date of entry into the UK, not from the visa issue date.
