Hi, I have tried to find the answers for my case from the old forums, not able to find the exact answers. So anyone kindly help me with this, please?
I've been overstayed in The UK since 2011. I have been with my boyfriend for a year, knowing each other since 2015. Our relationship is genuine, I have visited his family so many times, and we are gonna get married next month to make myself being legal to live here and settle down our life together. We are aware that doing a marriage register here is tougher than going back to my hometown and doing it from there, and then applying for a spouse visa to The UK. So we picked the choice of going back to do everything in my hometown, Asia country.
My questions are, the process of applying for a spouse visa for me, would that be as same as the process of people who haven't overstayed and apply for a spouse visa? Or there is anything else I have to do? Also, the time of process will be up to 12 weeks as the normal spouse visa?
I know there is The Human Rights Article 8.2 : if you have a family here (i.e parent, siblings) or you have been married to a British citizen. Should I mention this on my spouse visa application as well?
And If I am granted for a visa, my visa will be 2.5x2.5, then ILR like normal spouse visa, or my case will be different?
My boyfriend has a good job and he earns more than £18,600 a year. Having accommodation. Never been married.
