ILR - Tier 1 - dependent

Post by AH91 » Mon Mar 04, 2019 9:22 pm

Dear Guru's,

I'm due to apply for my ILR (Tier1-50K) in few months time with 2 dependants, where one dependent is in UK for over 2.5 years and 2nd is infant 3 months old (born outside UK)

Based on above situation, I have got 2 questions

1- What is maintenance funds requirement for both dependants, although I've read guidance but it is vague and subject to interpretation

2- Assuming, my ILR application will come through successfully, what sort of visa will be given to my dependants and length of stay ? Also does my dependent still eligible to apply for ILR once 5 years completed in this country ?

Your valuable advise would be much appreciated.

£630 per dependant

They will remain under PBS dependant visa, which issued for 3 years until they complete their 5 years for ILR

What about following guideline

71. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, you must have £630
to support yourself.

Also, Can I use my dependent bank account for maintenance requirement

My statement balance was up to required threshold until 25-02-2019! after that it was reduced for one day by unexpected DD so my question is, if I am applying in mid of April can I still use this statement from Dec to 25-02-2019 for maintenance funds. Please advise

If the closing balance (even for one day) was below the threshold, it is unacceptable

So what is oldest statement I could use assuming I'll submit my application end of March-19 ? I'd required balance until 25-02-19

Also, can i use my dependent's bank statement for maintenance funds?

thanks

You should show maintaining at least £630 continuously for 90 days. Dependants can rely on their own funds

I guess I don't need maintenance statement for myself as I am main applicant for ILR ??

Also, can I split the maintenance funds, i.e my partner can use her statement for maintenance requirement and I could my statement for 2nd dependent (infant) ?
