Marriage - What next?

Hi all,

I am an Irish and US citizen living in london for the last year and a half. I just got married to my Egyptian girlfriend who was staying in the UK on a 3 year student visa (of which 2 years were left). We had a to get a COA to get married and we got it no problem.

I wanted to enquire about how to change the status of my wifes student visa to a resident permit? Also does the process take very long and what rights would she have in the UK with a valid residence permit.

Also since I hold a US passport (even I havent lived there since I was 6 years old) .. I was wondering would it be difficult to get her a green card or equivelent to live and work in the US?

As you are an Irish citizen and your wife is already in the UK, she has a choice. She may either apply for FLR(M) (285) and subsequently for SET(M) (288) under the Immigration Rules; or she may apply for a resident card under the Immigration (European Economic Area) Regulations 2006, with these rights and responsibilities. Dear vinny,

I am a whife of an Irish Citizen and HO keeps telling me to apply under the EEA family member provisions. Could you please point me towards some kind of a document that confirms that I can apply for a 2 year visa, rther than having to apply for a 5 years EEA family member residence permit?

PS I am in the UK on a Work Permit right now, which is valid until end of 2010.
