Case being Reconsidered

Hi,

The Tribunal was ordered by the High court to reconsider its decision on my Appeal. I was appealing the 10 yr rule applied to me and was refused at the tribunal and court of appeal but was reconsidered at the High court.

Can anyone tell me what happens next. I have been waiting for the past 2 weeks and I have no reply.

The High Court instruction to the AIT should / could indicate how the case is to be reconsidered - there are three if not more options.
The AIT Tribunal can reconsider it - and overturn the orginal decision.
They could have another Tribunal hearing with all the parties.
They could send it back down to the "normal" AIT for it to be reheard in part or a fresh.

Recon's take a fair bit of time to resurface after High Court. They go through the Senior IJ's panel and are subjected to a great deal of thought as it is a bit of a rap on the knuckles for them!

Given the lack of court time presently avaialable it could be some months before it gets heard.
