can i apply for ILR

Post by anuje » Tue Jun 17, 2008 9:20 pm

Hi,
My work permit and leave to reamin is expiring 2 weeks before i complete 5 Years in uk in 2009. Can i still apply for ILR or do i need to ask my employer to sponsor me for Tier 2 and then apply for ILR. I will be very grateful if someone can guide me.
Thanks

you can apply 28 days before it expires but it is a risk

Please post the date of expiry of the visa, and the date it was first used to enter the UK.

i entered uk on 19th of jan 2004 to give interview and later my employer applied for work permit and i got the Leave on 13th of feb 2004. I am not sure te time i spent under visitor visa will contribute towards my 5 year period
thanks

The time spent under visitor visa is not counted towards the 5 year stay for ILR. You can apply for ILR 28 days in advance of completion of your 5 year stay in UK starting from the date of your first entry into UK on your valid work permit.
