I am messaging here regarding my partner’s Visa process. We are living in relationship since March 2015. My partner came to Uk in 2015 on student visa, she completed her course successfully.
I was previously married and with difference of opinion I was separated from my ex-wife, now we are legally separated since jan 2018.
My partner couldn’t marry to me as my divorce case was in court, so she applied for FLR (FP) in July 2016, it got rejected in April 2017, by that time we were expecting our first baby and she was 6 weeks pregnant.
Her solicitor informed us that they received refusal letter after 2 weeks of HO posted date and the second FLR (FP) made on the ground that I am pregnant. Refused in July 2018. By that time, my divorce case was sorted; we applied for PBS dependant, again refused stating that second FLR application wasn’t made on time. We have made admin review, which is also refused in Jan 2019.
Now I have got my ILR on 10 year route and 1 year old baby also got British citizenship. Now we are expecting our second baby, my partner is 7 weeks pregnant. Once the admin review got refused, we sent a letter to HO stating that her partner is applied for ILR and considering a baby, they need to give some time to take next steps.
We have got a response from HO stating, make a new application. By that time, my baby MN1 application was pending, so we left my partner visa process for a month, and solicitor advised once my baby gets her citizenship its easier, now my partner is overstaying for more than a month. We applied for baby’s British passport; now please let me know what would be a right option for us?
Has anybody gone through such situation, kindly share with me, it will be useful for us.
