Good day to all. Can someone give me advice regarding my case.
My immigration history.
I arrived in the UK May 2007.
May 2007 - June 2013 Student Visa. All my applications for extensions were made in time. No gaps.
November 2012, around 7 months before my leave expire on June 2013, I applied for discretionary leave to remain based on medical grounds.
It was denied on October 2013 with right of appeal.
Appeal was submitted on time.
Case heard October 2014 and I was granted 6 months leave (from November 2014 to April 2015)
I applied for extensions for the same type
of Visa on time.
My Visa was denied August 2015 with appeal right. Again, appeal was submitted on time.
Case was heard August 2016. The judge returned my case to the Home Office to make a lawful decision.
Home office sent me a letter denying my application with appeal right on February 2017. Appeal was once again submitted on time.
Case was heard sometimes in April 2018. It was adjourned and re scheduled November 2018.
HO granted me 30 months leave based on private life (January 2019 - July 2021)instead of leave based on medical grounds.

If I will submit an ILR (10 year long residence) this April, what do you think the effect will be on my current leave if the HO deny my application for ILR?
Can I submit an Ilr based on 10 year or wait till the end of my current leave?
Any comment will highly be appreciated.

I forgot to mention in my previous post about what the home office had said on their letter. Kindly read

" Further to appeal determination promulgated on 5th December 2018, your appeal has been allowed by the ftt on ECHR article 8 grounds, and you have therefore been granted leave to remain outside of the Immigration Rules for a period of 30 months. You can apply to renew this leave, and you may become eligible to apply for ILR after 120 months if you qualify".

What this means for you .
A biometric residence....

"In order to qualify for settlement you must have completed a continuous period of at least 120 months in the UK with limited leave granted because of family life.
Providing you continue to meet the relevant legislation at the time of application, you should apply for further leave prior to the expiry of your current leave via a charged application. Subject to meeting that criteria, you will be given a further period of leave of 30 months.
You may need to make further applications and you will need to satisfy the Immigration Rules to take your leave to the necessary 120 months required for settlement".

Conditions of stay. ....
Employment....
Public funds ...
Future application
"If your circumstances remain the same, following a continuous period of lawful leave to remain in the UK for 10 years and subject to meeting the requirements of the Immigration Rules at the time, you may apply for ilr in the UK. You must apply before the end of your authorised stay in the UK but no more than 28 days before completing that period".

1. Does these mean to me that my clock start again in January 2019? I got my leave based on family life starting this date.

2. My lawful stay from the day I came here in 2007 till I got my new Visa ( January 2019), were all disregarded despite all my previous applications and appeals were made in time?
3. As far as my knowledge is concerned, a combination of any type of Visa as long as an application and appeals were made on time, one can apply for ilr.

Ignore what the letter says. All lawful residence counts

Hi to all.
I would like to take this opportunity to say thank you to all moderators of this forum and to those people who had shared their good and bad experiences with their routes towards getting residence permit permanently. The information contained were a million bunch of help for me.
I just got my BRP card today, after 12 years of lawful and legal stay in the UK. That is exactly 40 days after my biometric appointment plus submission of my documents thru UKVCAS.
To all there who wish to apply for ILR on the basis of long residence, best of luck.
And please don't stop believing that when you do your best, you'll also get the best you deserve.
