Getting married in the UK

Post by it91 » Sat Mar 30, 2019 8:20 am

Hi,
I am non-EEA, resident here until the end of 2019 with Tier 4 doctoral extension visa, and my boyfriend is EEA with PR and resident for 6 years, eligible to apply for naturalisation.

1)We would like to get married in the UK. Which are the steps we need to follow?

2)He doesn’t have settled status, instead we sent his naturalisation documents. But we don’t know how long will it take and we want to apply for my residence permit or family visa. Is it better to follow EEA route, even though he doesn’t have settled status? When he will get his citizenship, after 2021 is it a problem, as all EEAs have to change their PR card to settled?

I’m so confused and hopefully someon can help me about the steps to get married in the UK on student visa and which route is better for my residence permit?

Thanks

How he applied for naturalisation ? Does he hold PR ? Or ILR for one year? You are not British are you ?

1)We would like to get married in the UK. Which are the steps we need to follow? As foreign Nationals, in order to marry in the UK you are required to give notice at a Home Office designated Registry Office. The Registrar is then legally bound to notify the HO, who can then extend your notification period from 28 to 70 days in order to interview you both before the wedding can go ahead, should they choose to do so.

This is confusing. You sent what 'naturalisation documents' to where :?:

Regarding the question 2: He has completed his 6 years in the UK and got his permanent residence card, therefore he applied for naturalisation a month ago, by sending the application online and supporting documents by post. It was more than a month ago, and I believe by the time we will get married (in june) he will already hear back from his application, and will be eligible to be UK citizen. So, is it going to be problem for my EEA route residence permit application? As he will not be "settled", but still have his permanent residence card.

Hi again
I was wondering if anyone can give me an advice. I have these questions:

I would like to apply to residence permit when I will get married to my permanent residence (PR) holder EEA husband (not applied to settlement).

1: His naturalisation application was accepted last week. But I don't want to go through the expensive BC route for spouse visa. Do you think is EEA or BC route better in our case? He hasn't got settled status, instead he applied for naturalisation. So if his PR is no longer valid after 2020 because of Brexit, is it better for us to apply through BC route then?

2: When I want to apply to citizenship am I supposed to change my visa status to spouse of British, in order not to wait for another 12 months after acquiring settled/ILR status?

3: If EEA route is better, what are the requirements? Do we need to submit bank details, proof of relationship etc, or not?

Thanks

Settlement or residence permit application for EEA spouse

Post by it91 » Wed Apr 10, 2019 7:33 pm

Hi
I am a non-EEA wife of EEA husband of permanent residence. We live in the UK together (I currently have Tier 4 doctoral extension scheme visa-residence permit) I would like to apply for spouse visa or any permit allows for me to stay here, by applying in the UK.

My husband has acquired his PR, and has not obtained "settled" status yet. When I apply for my visa or residence permit here, am I supposed to follow the new regulations and apply only for settlement? If he will have "settled" before I apply, is "settlement scheme" my only option? Can I still apply for the good old Residence Permit for EEA Family Members?

I hope I can get a good answer, as I'm very confused now.

Thanks
Isil
