Striker007 wrote: ↑Thu Feb 28, 2019 11:45 pmHi All,
I have few question about my husband ILR (MAIN APPLICANT) me & my son visa ( Tier 1 dependents).
1: My husband is on Tier 1 Entrepreneur and is eligible for ILR on 24/04/2019, as well as Me & my son (dependents) are due for extension on same date 24/04/2019. Can we apply together for his ILR & DEPENDENTS EXTENSION ? If your husband was granted intial visa on 13/1/2014 he is eligible to apply for ILR from 13/1/2019 minus 28 days given he has met the job creation requirements. Why do you think he is eligible from 24/4/19? I assume that will be the expiry date? Your husband has to apply for ILR and (you and your son) has to apply for PBS extension before your visa expiry. Your husband will use SET(O) and you will use PBS extension form. Your husband is eligible even now (given he has met job creation). Anyways, you all must have to apply before your valid leave ends
2: Or is it safe, if he applies first for his ILR as he is main applicant and once he got approval , he can apply our visa extension ? Irrelevant, you have to apply before your valid leave ends. But your PBS extension decision will be made only after his ILR decision is made
3: Do i have to go back my home country to apply for dependent visa if he didn't get reply before our visa expiry 24/04/2019 ?
Or we can apply dependents extension before visa expiry regardless of his ILR status ?No. You will apply PBS extension in UK. As stated above, you have to apply before your leave ends to make an intime application but will only be decided after your husband gets a decision on ILR. Note: Even after your husband gets ILR do NOT change your visa route and stick to PBS extension and complete 5 years on that to qualify for your own ILR. If you switch visa after your husband gets ILR, your ILR clock will set to zero and you will need another 5 years to qualify for ILR
4: How much maintenance (total funds) he needs to show in his bank statement for 3 ( main applicant and 2 dependents ) ?
https://assets.publishing.service.gov.u ... 1-2019.pdf check here
5: After getting his ILR, my visa status will be same as Tier 1 dependent spouse or it will be changed ? You will stay on PBS dependent route till you complete your 5 years to qualify for your ILR. No need to change
6: How long it will take for ILR decision ? Tier 1 main applicant can only go for standard service that is 6 months. Many have got visa in 3-3.5 months but some are even waiting more than 6 months
I hope i made my point clear for you to understand.
Please reply my to help me out in this.
Many Thanks.
Your husband does not need any maintenance for himself for ILR. He does not need to show any personal bank statements for his ILR. There is no maintenance requirement for ILR.Striker007 wrote: ↑Sat Mar 02, 2019 12:20 amHi..
Thanks for your detailed answer. It make sense.
Can u plz explain this also..
1: As I'm in UK more than 2 years, so for me maintenance funds is £630 ? As per guide line
2: For my Son, who is less than 6 month in UK, funds will be £1890 to show ? Or how it will work ? Can i use my bank statement for my son ?
3: As my Husband applying for ILR so his bank statement will be different to show ?
Its so confusing...
Help me out
YesStriker007 wrote: ↑Sat Mar 02, 2019 1:02 amYeah i have read this page & guide line, that's why its not clear, so i just want to make sure about him.
But if me and my husband we both attach our bank statement, it would be fine or No ?
I know we are dependents but for our son both parents's statements can work, Right ?
