Hi,

I have been on this forum very long time. My tier 1 ext is still in process from 24 Aug 2017. I would like to ask respected members of this forum that can I apply ILR based on one part time employee on five years route in end of July 2019. as I heard you can apply 28 days before. Also I want to let you know my 10 years would be completed in September 26. As i entered in this country in 23 Oct 2009.
Can respected members guide me what possibilities are there for me.

If you applied in-time you can apply for ILR

An 'in time' application is when you make a new application before the expiry of ur current visa.

The requirement is creation of 2 full time jobs 12 months each. A full time job is defined at 30 hrs per week.

Wasn't ur passport sent back by HO?
You'll vary ur current ext to ILR.
Assuming you have 2 jobs existing for at least 12 months preceding the time of ur ILR application
The documents would be the same as extension as ur ext hasn't been decided.
Only difference is now you ve fulfilled continuous residence.
Recent CAR dated within 3 months, Business bank letter and a few others.
Search the forum to understand and read the guidance. A few changes have come about.
So even if your initial visa was granted before 6th april 2014 you can no longer claim transitional arrangement.
You will have to write up an overview of your business and your role within it
A job description of ur Jobs.
Accounts spanning past two years since extension application.
Job creation, RTI fps n payslips of employees + copies
Run a dummy application to get the feel for it.

You can apply 28 days before you reach the 5th anniversary of ur initial tier 1 visa issue date.

Im just wondering that if you mange to vary ur application and still don't hear from HO with regards to ILR, which is quite likely as it would take at least a couple of months, as only they know why they are still considering it, would you be able to vary again to LR as soon as you qualify.
