10 year work history involving over 20 hours work per week

Hi all,

I've been on ILR for over six months now and thinking of applying for citizenship as soon as I qualify. However, I have some doubts with regard to part time work I've done whilst I was a student. I came to UK in late 2009 and was on Tier 4 student visa doing a post graduate taught course. My visa stamp stated 20 hours part time work per week during 'term times'. However there were months I might have gone over this quota, probably by 20 -30 hours per month but this isn't the case for every month. Also, I remember there were months when I was underpaid for the hours I worked and it was rectified the following month hence receiving more money than I'd have if I worked only 20 hours a week. I'm starting to worry if this will become a problem if HO checks with HMRC. Is it worth waiting till I have past the ten year period then I have a clean record of work to include in the form? If I was to refuse my application on this basis will that affect my ILR as well leading to a deportation? I haven't had any issues with HO so far and I finished my degree on time then switched to PSW and subsequently T2 till I received my ILR last year.

20-30hours a month isnt an issue as the students get 20hrs per week of allowed limit. So, you need to only worry if you were above 80 hours a month..and they see an average of whole year not just a month. Term times could be different for different universities depending on course structure. And including holiday period of Christmas, Easter it levels your average. Unless you were not studying actually and only working.

As I mentioned they take average for whole tax year. If you are concerned, I would suggest you to contact HMRC directly and understand this bit. They will be happy to explain you over the phone.

it does not matter if you work more than 20 hours per week.
when you apply your sign form that since you come in uk you did not make any violation of immigration rules
i work whole 10 year over 20 hours.

they only check while you working in your student visa time you will allow working or not
example you got student visa with 20 hour work than next visa you have no working college admission.
because your old visa has working right and you have NI no. so some time people work with same employer.
they did not bother in old time. that called you break immigration rule in that year home office will consider 10 year that you apply again
like 2011 you have no work visa and you work its meaning you can apply 2021.

otherwise do not listen people just apply you will get it.#
