Can an illegal immigrant legally marry in the UK?

Post by sprig » Sun Apr 21, 2019 8:43 pm

Hi,

(This is not me, asking for someone else; it is very complicated).

Can someone who is a non-EU overstayer in the UK legally marry a EU citizen, who is living in the UK/can they get married to another British citizen while they have overstayed?

Also, will the HO treat everyone equally regardless of disability - as in an illegal immigrant who deceived someone else to get to the UK and may be using their disability as an excuse to stay in the UK?

Finally, can an illegal immigrant be granted citizenship/FLR if they have been here for a certain amount of time, illegally? (ie 5 years/10 years?)

Thanks.

I believe you have to use a registry office approved by the Home Office and they will look into the circumstances. Getting married as such doesn't resolve the overstaying.

Also, will the HO treat everyone equally regardless of disability - as in an illegal immigrant who deceived someone else to get to the UK and may be using their disability as an excuse to stay in the UK? Doubt you could use any disbility to justify your stay in the UK - by legal or illegal means.

Finally, can an illegal immigrant be granted citizenship/FLR if they have been here for a certain amount of time, illegally? (ie 5 years/10 years?) For naturalisation any kind of illegal stay / overstay will not be counted towards the residency requirement. And you will have to wait up to 10 years from the date of regularising your stay, to be able to rre-apply.

Thanks.

In addition to alterhase58 's advice, in order to marry in the UK they would have to give notice at a Home Office designated Registry Office. The Registrar is then legally bound to notify the HO, who can then extend the notification period from 28 to 70 days in order to interview the couple separately before the wedding can go ahead, should they choose to do so.

Someone without the legal right to reside in the UK risks being detained during the interview.

Your post is slightly confusing....you mention marriage to an EU citizen and also to 'another' British national. :?
