Application for naturalisation: with PR or Settled Status?

Post by Xter27 » Sun Apr 21, 2019 5:18 pm

Hi all,

I’ve tried searching for this info on the gov website, but didn’t find anything conclusive.

I might apply for naturalisation in the future. I am an EU citizen - acquired PR in 2014 and should be eligible for settled status now.

So, I could apply for naturalisation now since I’ve lived here on a PR basis long enough. Having said that, would I need to wait an additional 12 months if I successfully applied for settled status now?

If you have your pr since 2014 so apply for naturalisation not sattle status as you still have until 30 Jun 2021 for your pr to be valid if UK leave with a deal or until 31 December 2020 if no deal reached so your pr still valid now and you can use it for naturalisation

I would do exactly that, but as the law of the country of my citizenship currently stands, dual citizenship is not allowed and I am not prepared to lose it. However, there is a vote taking place to change that law. If passes, I would then apply for naturalisation.

In addition, I am the sponsor of a non-eu family member, so that’s another reason why I cannot lose my EU passport. I may be able to apply for naturalisation within the next 12 months due to the reason mentioned earlier, hence the original question.

I don't think it makes any difference for naturalisation if you apply for settled status or not.

For one, the requirement for naturalisation is to have been free of immigration time restrictions for 12 months, not to have been so under a specific rule or category. That it, it's not like settled status, where you have to have been in the UK for 5 years under EU rules (but other visas don't count), or ILR, where you have to have been in the UK for 5 years on a spouse visa. For naturalisation, it's just the freedom from immigration time restrictions that counts. You have this freedom under both PR and settled status, so having a combination of both should be OK.

And also, settled status doesn't "replace" PR at this point, at least for as long as the UK is still in the EU, and possibly even during any transition period. While EU law applies, you have PR under EU law, even if you also get settled status under UK law.

That's all just my understanding of things, of course.

Thanks for the reply. I agree with your points above and my opinion is the same. Let’s hope they add support for Apple devices soon!
