A cry for help, so lost in these whole immigration stuff.

Previously in the UK for so many years from a minor age, every application made whist in UK got turn down. (Refused)

Then, I gave up applying.

Then moved to Dublin in Ireland (satte-less, no documents nothing) by ferry (tro a friend). While in Dublin I found love (my partner, His BRITISH Citizen), we gave birth to our lil girl. We got her Irish Passport and then I was able to apply for Zambrano. (Which till now am still waiting to hear back from the Irish department of justice and equality over a year going to two).

My questions are.
Since I still don't have any form of documentations and am a non-EEA, can I apply the New ٍSurinder Singh Scheme? (Paper or Online Application) Reading this post about me do I qualify ?

Anyone know which applications I can apply for to return back to the UK with my partner and our daughter. (Ireland no offense but it boring no jobs nothing, and am used to the UK life since I grow up there)

And would all previous applications refused in the UK back then, affect any new visa application I'll make now outside UK.

And can I apply for a British Passport for our daughter?

As your child is an Irish citizen, you can move back with her to the UK under the Chen judgment (for the carers of non-British EEA citizens). Alternatively, you can speak to the EU Settlement Resolution Centre to apply for pre-settled status.

Surinder-Singh does not apply unless you are moving back with the British father of your child.

Yes, the child is eligible to apply for a British passport as one parent was a British citizen at the time of the child's birth abroad.

Thank you for your prompt reply, would you by any chance know if all the previous applications refused in the UK back then, affect any new visa application I'll make now outside UK, would it affect it?

And my partner is willing to move back with me, but we are currently still job hunting for him so we don't go there and he'll have no job.

I disagree with you in many respect. Firstly i am unsure chen can apply in circumstance where a child is also a British Citizen, as conditions cannot be placed on the right of a British Child to stay in the UK. Under International law, that is illegal.

I disagree that Singh does not apply. The child is a British Citizen in Ireland, and he is obviously exercising his right under EU law and Article 21 to live and reside in Ireland, so far as EU law is concerned. Therefore there is a cross border activity and his matter is not purely internal. He is allowed to return to the UK under surinder singh.

I think Ireland is a lovely country, I think prefer Ireland to many European countries(UK included). There are clearly many jobs in Ireland, if you have the appropriate skills.

I do not know why you did not apply with your partner as a permitted family member.

You have been in the state for over 2 years and have a Child with this British Chap. You clearly would have been able to apply as a Permitted Family member and then the department would have issued you with a Temporary Stamp 4 which will allow you to work, and then a decision would have been made on your application by now.

If you partner is exercising treaty rights in Ireland as a worker or self employed person, my advise will be to apply as a Permitted Family member using EU 1(A) form.

Don't get me wrong please Ireland is a lovely country, I do enjoy the quietness, but mayb not for me, outside London transportation, can't not be compared to Ireland County transportation. UK Medical can't be compared to Ireland's, am used to the London life and things are extremely expensive and the small county where I live no jobs nothing, I even drop my CV for a cleaning job they didn't call but yet they still looking for a cleaner. If one does not drive in the counties in Ireland it's difficult to move around.

But yea anyways, didn't apply for the Permitted Family member using EU 1(A) form, we knew someone that waited and waited and waited, all they keep giving her is temporary stamps 6mnths the 3mnths the at some point they won't give her if it's expired. Not knowing Zambrano would take forever too.
