UK Tier1 - Doubt regarding Period Of Earnings

Post by tier1_king » Sat Jun 28, 2008 7:04 pm

Hello ,
I will be able to apply for Tier 1 only after 22 September 08.(this is because i have just started to maintain 2800 gbp required for maintenance criteria from 22 june 08 )

Now i have a doubt in previous earnings section.. the documenation states that ''Points for Previous Earnings can be claimed in respect of any single, consecutive 12 month period from the 15 months immediately prior to the date of application. "

Suppose if i apply on 23 Sep '08, 15 months immediately prior to the date of applicationwould be 23 June'07.

In this case , can i also include June'07 (ie.,the period 01 June'07 - 30 June'07) in my earnings ?

ie., Is it possible for me to claim from 01 June'07 to 31 May'08 (12 Months)..or shoule i take the range from the next calendar month after June 23'07 which would become then ... 01 July'07-30 June'08

please advice.

thanks and best rgards,

Read the guidance notes *carefully*.
Tier 1 policy guidance wrote:68. All periods specified should be considered to refer to calendar months (i.e. 1 January – 31 January).
If you apply in Sept. '08, your 15 month window for previous earnings is 01-Jun-07 to 31-Aug-08.

Hummm....They have now changed their interpretation of "calendar month":

In the new Tier 1 policy guide http://www.bia.homeoffice.gov.uk/siteco ... yguide.pdf:
79. All the periods we specify are calendar months (for example 14 January – 13 February).

I did a search using keyword "calendar" in the PDF document (Tier 1 policy guidance for in-country applicants) on the UKBA website ( http://www.bia.homeoffice.gov.uk/siteco ... yguide.pdf , accessed 30-Jun 02:47 BST) and it shows only this result:
68. All periods specified should be considered to refer to calendar months (i.e. 1 January – 31 January)
And para 79 relates to full-time study
Documentary requirements for full-time study
79. For the Assessing Officer to consider earnings from a period outside the 15 months, on the basis of full-time study and for the purposes of paragraph 245F of the Immigration Rules, the documents specified are as follows: ....
And the document still mentions the transitional arrangement for maintenance funds, so don't think this one (that I am accessing) is the new one. Maybe UKBA is trying to update their website .. with new guidance / forms expected today ... but having some teething issues? :?

Best to check back after a couple of hours.

Yup, this is indeed what the new Tier 1 policy guidance says (accessed 30-Jun, 04.24 BST)
