HSMP - Work Permit

Post by giprekha » Fri Jun 27, 2008 10:42 pm

Currently I have a HSMP Approval letter dated on 05 March 08, Now My company has applied for Work Permit in recent days, i am planning to come on WP and get my HSMP stamping here from UK.

My Question
Will their be any consents, having a HSMP Approval Letter when applying for WP...?

Can i get my HSMP VISA Stamping after coming to UK on new WP, which was applied after HSMP approval letter, will my HSMP Approval Letter would be valid after issuing a WP on my name...?

Thanks for your support, and looking forward for you reply.

I'm confused. HSMP holders do not require work permits.

While you can switch from WP to Tier 1 from within UK, why would you want to do that? Whay go for WP at all and why not apply for EC from your home country, if you have the time? Anyhow, I believe you have your own reasons for taking this route.

Please note that the normal processing time for applications here in UK stands at 10 weeks (as currently advised by UKBA), while it might be less than 4 weeks in your home country.

And I believe you will need a year long WP (at least) if you want to switch status in-country (though not sure, if this is indeed the case).

If your company succeeds in getting you a WP, your HSMP will automatically become void. You can only be on one status at any point of time i.e either WP or HSMP.

I don't think this is correct. If you have HSMP entry clearance stamped and then go for a work permit EC this will supercede your previous (HSMP) EC. However if you just have a HSMP approval letter and work permit EC, then you should be fine. Just make sure that you have HSMP EC (residence premit etc) done after your work permit.

The OP has a HSMP approval letter and not an HSMP entry clearance endorsed on her passport (yet).

So ther is no question of her HSMP becoming void. A new endorsement supercedes an existing endorsement ..... it doesn't invalidate a "formal" approval confirming admission to an immigration category.

Thank you, one and all for taking your valuable time to answer.

I do not have a HSMP EC, only I have HSMP Approval letter 1st level work was done.

I Used to be on a WP in UK with a different Role from October 2007.

Now my Roles has got changed and my Company has applied for New WP, mean time i got my HSMP approval letter from Home Office, now i cannot say not to go for WP to my company, becuase they have cancled my previous WP.

It is good infact because i am maintaining 2000 GPB in UK Bank to get my HSMP EC from UK.

To go to HSMP EC from India i need to maintaint 2,800 GBP which i am doing in UK Bank account assuming that i will go for HSMP EC from UK when i applied.

If Home office is issueing WP, will my HSMP approval is still valide ?.
If am coming to UK on WP which was issued after HSMP approval letter, can an as for HSMP EC from UK ?.

Many thanks and kind regards for you valuable time.

1. Yes, your HSMP approval will be valid even if a WP / EC based on WP is issued to you. Just remember not apply for any EC/leave to remain in any other category once you have HSMP/Tier 1 stamped on your passport -what you do before that has no impact on your HSMP approval or immigration status.
2. Yes (provided you fulfil the maintenance funds requirements, which you say you do).

Me too facing the similar issue

Post by vijayvvd » Tue Jul 08, 2008 10:27 pm

My organisation has already started processing for work permit(due for renewal on oct08 1st week), however I am applying for HSMP Tier 1 in next week:
My query is :
1)If my HSMP tier 1 (applying within uk) gets approved (as per tier 1 approval + visa is a single instant --correct me if I am wrong here) and it's stamped on my passport . what would be issue with my wp application ...will it be processed? (I donot want my employer to know officially that I have HSMP)
2)if wp gets issued after HSMP , and I donot get my visa stamped based on wp (as i will be having hsmp visa) ..is it legal.
3) Is it safe to assume it will take 4-5 weeks for HSMP TIER1 , If all documentation is perfect.
4) Can I show Fixed deposit (with SBI, Mumbai) as part of maintenance requierement for my dependent while applying within uk (FD is one year old , so fullfills 3months requirement)

(Please accept my apologies , as I am reposting my question . I have not received response and I do have only 1 week to decide thanks)
