To work in uk as a EEA resident (Married to EEA National)

Post by Voyn » Mon Jun 10, 2019 6:47 am

Hi experts!
So i am thinking to move to uk. Me and my children have spanish passport but my wife does not. she has pakistani passport and spanish residence card[with the line"family member of EEA national" which i assume, makes it a article 10 residence card].

My doubt is:
1.does she need a visa to enter and work in the uk?
2.if yes, what i have to do to take her with me so she can live and work there..as we both are thinking to work in uk.
Have a nice day :)
Thanks

Strictly speaking, she can legally enter and work in the UK without any visa or permit, BUT she might encounter problems when trying to board a plane to the UK or proving her right to work without a Residence Card. In other words, one thing is to have a right, another very different one is to be able to prove that right. Sometimes people do fine with just the marriage certificate and an Artilce 10 card, sometimes they encounter huge troubles.

Absolute best thing to do is to apply for a 6-moth a EEA Family Permit in Spain for her to enter the UK, this is free and usually treated as a priority application. Then as soon as she is in the UK, either apply for a EEA Residence Card for her, or you can both apply for Pre-Settled status. Which one you apply is up to you, there are pros and cons of both options. For guidance read this post.

Thanks a lot for the valuable information provided by you :)
I am going for an EEA family permit.. but i am little scared as i dont have any job in uk. I only have my national insurence number that i got a couple of years ago.. but due to family problems i had to come back to spain without even working there.
Do you think there would be any problem?
Btw the application is free but they charge you a lot for taking your biometrics(137€ in my case  )
Thanks in advance.. mate.
