Dear all,
I need some advice to make a decision about my immigration status.
Current status : FLR fp 10 year route.
Wife nationality : British / Irish
I am considering my wife surendring her British citizenship and only keep her Irish passport to enable for us to apply pre settled status for me as for fp is very expensive and 10 year route to settlement.
Back in 2017 when I applied flr fp we made this choice because she wasn’t working and couldn’t prove her exercise of treaty rights and also dual citizenship was a problem.
Now with brexit things have changed and I am feeling that it may be better option.
My question is
Is it possible to apply pre settled status of she surrender her British nationality?
Is there no requirement for her to work or exercise treaty rights and is the mere residence enough for this purpose?
And if pre settled status granted our residence int those 5 years will be enough to gain settled status without her working etc?
Any advice highly appreciated.
Thanks in advance
