5 years completed on tier1 entrep extension still pending

Hi ,

my 5 years on t1 entp are completed while my application for extension is still pending ,

can i apply for ILR , i had a word my with solicitor he said you cannot apply for ilr Until n unless you get this extension approved :S

You can vary your extension application to ILR using the SET-O form

i dont think so we can apply for ILR until n unless we have been granted extension ,

cos you don't fulfill the employment requirement

we cannot do it

The jobs must have existed for at least 12 months during your most recent
grant of leave or, where that leave was granted less than 12 months ago, for at
least the 12 months immediately before the date of your current application.

If you are applying for a second extension or 5 year settlement application:
• You can only score points for employment activity from your most recent extension period
of leave.
• You cannot claim points for any employment activity from your initial period of leave (as
this can only be used to score points for your first extension application).

we cannot do it

As long as the extension application is not decided, the initial grant period is extended. So the most recent grant of leave is the initial grant period. You can use the same job evidence that you used for extension to apply for ILR.
