Appeal timeline , process and outcome.

Post by Everythingworksout » Mon Apr 08, 2019 6:17 pm

Could you please share your appeal timeline and outcome ?
After recieving Akcnolodgement of notice of appeal, how long did you wait to get a hearing date?
what happened at your hearing, if appeal was allowed how long did it take to get your BRP.

It will help give us waiting a bit of hope and some guidance on what to do while waiting.

Hi, yes I was lucky to get a hearing within 2 months,

I had my hearing last month, still waiting for the decision of the judge.

When did you apply to appeal ?

Hey
So basically, after applying for an appeal (in January), we heard from the FTT regarding our hearing date in less than a month (in February). The hearing date was scheduled for 4 weeks later (in March).
The court was adjourned on the first hearing, and the second hearing date was for around 3 weeks after the first, i.e. in April.
The judge mentioned that we'd be receiving the decision within 2-3weeks of the hearing.
Apparently we didn't receive anything regarding the decision even after more than a month of the hearing, until we received a letter from the FTT regarding the HO having filed an application for permission to appeal to the UTT, and that is when we found out that our appeal had been allowed but we were not notified or sent the decision letter that had originally been issued within 2 weeks of our last hearing, infact the Home Office had received the decision and had planned to apply for permission to appeal further.
The Home Office's application for permission to appeal in the UTT was denied by the FTT.
We did not hear anything from the Home Office after this (while hoping that the Home Office had not applied further to the UTT, which is their last resort), until around 7 weeks later, we received a letter from the UKBA asking us for personal/bank details etc for them to refund us the court fee since we had won the appeal at our last hearing, and so we assumed that to mean the Home Office did not pursue the case further.
Our court fee was refunded, but we have still not heard anything from the Home Office. No letter of acknowledgement or implementation or even no sign of BRP yet.
More than a week ago, our lawyer had written to the Home Office regarding the delay in BRP and visa issuance, and as yet, we are still waiting to hear from the Home Office. So far it has been absolute silence and a long wait from the Home Office's side.

Hey big congratulations! I hope you get your passport back soon.

I heard back from the courts last week, My appeal has been allowed. So I am just waiting for the next steps.

I'm glad you have been sorted now. The wait and anxiety is unprecedented.

Sorry I meant to ask, Did you apply before the IHS was increased or after.

If you applied before IHS was increased, Were you asked to pay any extra IHS fees before your CARD was sent to you ?

I applied when IHS was just £500.

Many thanks in advance for your reply.

Apologies for the late reply.
Thanks, we received the passport earlier this week.

Congratulations on your appeal being allowed! Hopefully you'll hear from the HO before long.

Actually it was my husband's application for ILR (LR) and as far as I'm aware IHS does not apply to settlement applications and so if I'm not wrong, my husband didn't have to pay any of it when initially applying.
