SET(M) Driving Offense Query

Hi All. I will be applying for SET(M) early next year, and I am currently in the process of getting things organized now. In August 2017, I was pulled over for using a mobile phone while driving. I accepted the ticket issued by the officer. I later received a follow-up notice from the South Region Fixed Penalty Office. It was for 6 penalty points on my license and a £200 fine, which I paid. There was no court appearance involved. Do I need to declare this on the SET(M) application and, if so, will this be an issue for the application in general? Thanks in advance.

The penalty has been spent. There is no more issues at all. It takes 24 months to spend a penalty, also you don’t need to declare it , it makes no difference at all. If you declare it it won’t affect your ILR decision. You may choose to declare it but mention it’s been for over two years.

Thanks for the reply, but the FPN isn't considered a conviction, so I wasn't concerned about spent vs unspent. For better context, the question on the application I am referring to asks "At any time have you ever had any of the following, in the UK or in another country?"

There are then several options, one of which is "A penalty for a driving offence, for example disqualification for speeding or no motor insurance".

If you select that, it then gives you a choice between three further options -- Disqualification for speeding, no insurance or something else.

My question is, does my experience described in the previous post rise to the level of what this is asking for? I've seen this answered in both the affirmative and negative elsewhere online and am confused about what to do and thought this would be the best place to ask for further clarification. Thanks.

This section you are talking about is for very serious traffic offences like no insurance, drunk driving, dangerous driving, etc and not for common offences like speeding and traffic light crossing etc. You can simply choose NO there and make a declaration of your offence in a cover letter along with your application
