need info on immigration law concerning chinese nationals

Post by johnconner » Sat Jul 12, 2008 10:21 pm

hi, i have a chinese girlfriend, we have recently moved and she has not been able to find a job yet.
her visa is due to run out in october, and her visa dicates she must have 3000 in her account for atleast 3 months prior to her visa running out. this doesnt look like it is going to be possible, so im wondering, what else can she do?

she is looking at going to a college to learn english again in the hope that they wont deport her, but i dont know if it will work.

can anyone shed some light on the law concerning this?
what would she need to do to stay here?

thanks alot for any info

Where does it say so? - a letter sent by UKBA? or their website??

AFAIK, this is a requirement under PBS scheme only. Hence the question(s)!

PBS you already know - Point Based System. Earlier HSMP and now the Tier 1 scheme.
AFAIK - As far as I know!

As pointed out above, for in-country applicants the requirement is to show they have access to 800 pounds that the applicant has maintained everyday for 3 months preceding the application.
Maintenance funds wrote:If you are applying from within the United Kingdom, the balance must show that you have had at least £800 in your account at all times over the three-month period.
Unfortunately, this is a mandatory requirement and there is no way out (apart from changing to another visa category).
